End-User Licence Agreement (EULA). Review the legal terms governing the licence to install and use the BudgetFitter® mobile app on your device in the UK.

This End User Licence Agreement (“Agreement”) is a binding agreement between you (“End-User” or “you”) and FozDigital LTD (“Licensor,” “we,” “us,” or “our”). This Agreement governs your use of the BudgetFitter mobile application and browser extension, including all related documentation (the “Licensed Application”). The Licensed Application is licensed, not sold, to you.

By downloading, installing, or using the Licensed Application, you (a) acknowledge that you have read and understand this Agreement; (b) represent that you are of legal age to enter into a binding agreement; and (c) accept this Agreement and agree that you are legally bound by its terms.

This Licence Agreement may not provide for usage rules that conflict with the latest Apple Media Services Terms and Conditions or Google Play Terms of Service (collectively, “Usage Rules”). We acknowledge that we have had the opportunity to review the Usage Rules and this Agreement is not in conflict with them.

1. THE APPLICATION

The “Licensed Application” refers to the BudgetFitter software, which includes our Mobile App and Browser Extension, designed to help users save money by providing a centralised platform for verified discount codes and deals. It is customised for iOS, Android, and major web browsers (such as Chrome and Firefox).

The Licensed Application allows you to:

  • Search for, discover, and access up-to-date and verified discount codes.
  • Create a personalised feed by following your favourite brands.
  • Receive push notifications for new offers from followed brands.
  • Utilise smart savings tools like FitterTools and our AI Deal Finder.
  • Securely create and manage a user account.

2. SCOPE OF LICENCE

2.1. You are granted a non-transferable, non-exclusive, non-sublicensable licence to install and use the Licensed Application on any devices that you own or control, as permitted by the Usage Rules.

2.2. This licence will also govern any updates provided by the Licensor that replace or supplement the original Licensed Application, unless a separate licence is provided for such an update.

2.3. You may not share, sell, rent, lend, lease, or otherwise redistribute the Licensed Application.

2.4. You may not reverse engineer, decompile, or attempt to derive the source code of the Licensed Application or any part thereof, except with our prior written consent.

2.5. Violations of the obligations mentioned above may be subject to prosecution and damages.

3. TECHNICAL REQUIREMENTS

The Licensed Application requires a modern operating system (such as iOS 15, Android 11, or higher) or a modern web browser. We attempt to keep the Licensed Application updated for new versions of operating systems and browsers, but we do not grant you the right to claim such an update.

4. MAINTENANCE AND SUPPORT

We are solely responsible for providing any maintenance and support services for the Licensed Application. You can reach us via the contact details provided in this agreement. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

5. USE OF DATA

You acknowledge that Licensor will be able to access and adjust your downloaded Licensed Application content and your personal information. Our use of such material and information is subject to our Privacy Policy, available at: https://budgetfitter.co.uk/policy/privacy-policy/.

6. USER-GENERATED CONTRIBUTIONS

The Licensed Application may provide you with the opportunity to create, submit, or post content (“Contributions”), such as reviews or referral codes. You are solely responsible for your Contributions and represent that they do not violate any third-party rights or any of our Prohibited Activities as outlined in our main Terms and Conditions.

7. CONTRIBUTION LICENCE

You retain full ownership of your Contributions. However, by posting Contributions, you grant us an unrestricted, unlimited, worldwide right and licence to use, host, reproduce, and distribute such Contributions for any purpose. We are not liable for any statements in your Contributions.

8. LIABILITY

Our responsibility in the case of violation of obligations shall be limited to intent and gross negligence. In any case, liability shall be limited to foreseeable, contractually typical damages. This limitation does not apply to injuries to life, limb, or health. We take no accountability for inaccuracies in offers provided, the actions of third-party merchants, or user decisions made based on the information provided.

9. WARRANTY

Licensor warrants that the Licensed Application is free of spyware, trojan horses, viruses, or any other malware at the time of Your download. NO WARRANTY IS PROVIDED for the Licensed Application that has been modified, handled inappropriately, or used with inappropriate hardware or software.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify the App Store or Play Store operator, and they may refund your purchase price, if any. To the maximum extent permitted by law, the store operator will have no other warranty obligation.

10. PRODUCT CLAIMS

FozDigital LTD, not the App Store or Play Store, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or privacy legislation.

11. LEGAL COMPLIANCE

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

13. TERMINATION

The licence is valid until terminated by the Licensor or by you. Your rights will terminate automatically if you fail to adhere to any term of this licence. Upon termination, you shall stop all use of the Licensed Application and destroy all copies.

14. THIRD-PARTY TERMS AND BENEFICIARY

You must comply with applicable third-party terms of agreement when using the Licensed Application. You acknowledge and agree that Apple and Google, and their subsidiaries, are third-party beneficiaries of this Agreement and will have the right to enforce it against you.

15. INTELLECTUAL PROPERTY RIGHTS

In the event of any third-party claim that the Licensed Application infringes that third party’s intellectual property rights, FozDigital LTD, not the App Store or Play Store, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

16. APPLICABLE LAW

This Licence Agreement is governed by the laws of England and Wales, excluding its conflicts of law rules.

17. MISCELLANEOUS

If any term of this agreement is invalid, the validity of the remaining provisions shall not be affected. This Agreement constitutes the entire agreement between you and FozDigital LTD regarding the Licensed Application.
